Why would Shiva management send out a 2nd proxy vote, if they had the votes already!??? Every thing smells here. By agreeing to the the MOU, management infers that there was merit to the charges. I do own/control a modest number of shares. I did vote NO!! I have looked over both proxy statements, but have not read nor seen the official lawsuit documents. I did not join the lawsuit, but I have questions. How much money did the lawyers get. Did the plaintiffs get paid any money at all, and if so, how much? Was the suit filed as a Class Action, really? Seems to me that a plantiff has to get something before his lawyer can be paid!!! Doesn't the plaintiff have to agree to dismiss the suit, not the lawyers? If it was filed as a class action, where is our share (if applicable) ???!!!! I am NOT a lawyer, thus I have limited knowledge of such things. Maybe someone should find out these things before or on Friday. I am not saying that managment paid off the lawyers and the plantiffs to drop the suit, and leave everyone else out in the cold. Many other questions need to be answered. Maybe someone else can shed more light. Maybe the Law firm and Plantiffs would consent to put all the court documents including the entire settlement on the Web for all to see!! That would certainly answer some questions. I can not attend the Meeting Friday. Maybe someone else can run with this. Would love to hear from one of the Plantiffs, or know if they were silenced by the mou settlement.
