Smith Barney upgrades BIGT! Isnt there a silent period for IPOs?

BIGT started trading on Feb 19. Smith Barney was one of the
underwriters. I always thought theres a 25-30 day quite period
after an IPO...so, how did Simth Barney issue an upgrade?
