From a TA point of view:

Good that we broke above 2 3/8. If we close above 2 3/8 (especially on a bad market day) then the probability of Vivus going back down below 2 3/8 is slim at this point of time.

At the very least we will continue to have bits of good news released concerning further EU approvals that will generate further milestone payments etc...

At the very most we might actually get that long awaited domestic partner.

I believe that all the bad news is out of Vivus and there now is only one way to go.

As more and more of the short positions are covered it gives the market makers less and less reason to short on strength. At a certain point the market makers who have been responsible for manipulating Vivus to the downside will only benefit by running the share price to the up side.
