Ref: Inform about legal situation "Dayton Mining with Olivos, Gumercinda"

Dear Sir:

On December 16th, 1998 I informed you about the situation of the "Dayton Mining Company with Gumercinda Olivos" indicating you that we were going to recur to the Honorable Supreme Court Of Justice.

On December 28, 1998 the resources of Cassation the Form and Background were referred to the Honorable Supreme Court of Justice.

Up to date the following trials are at the Honorable Supreme Court of Justice:

1. Resource of Cassation in the Form and Background, Entrance No. 581-98, related to mining servitudes of the Planta de Beneficio Churrumata Place.

This trial will be probably allegated during the month of April 1999, it has the number 14th., in the schedule of the 4th Room of the Honorable Supreme Court of Justice. Narrator will be Mr. Silva.

2. Resource of Cassation in the form and Background No. 359-99 related to nullity of Mining Concessions (Marilola 1-6 Concessions). This trial will be probably allegated in half a year.

3. Resource of Cassation in the form and Background, entrance No. 260-99 related to Nullity of Mining Concessions (Marijen 1-2 Concessions). This trial will be probably allegated in half a year.

All these resources are duly founded, being sustained in new legal and principle records, so the Honorable Supreme Court will be obliged to resolve.
