Don't be fooled by judge's comments. These guys like to surprise. I was a witness in one corporate type of lawsuit. All through the trial, it appear the judge was making fools of our lawyer and witnesses, including myself. I thought no way do we have a chance. The other side's lawyer was sharp while ours was "dull" and stupid.

Guess who won----We did. Much to my amazement.
Judges want to give the impression that they are either neutral or on the underdog's side. When the decision comes, they behave differently.

Just imagine him siding with MSFT---he will be able to shock everyone (except me of course)
MSFT knows this--maybe that is why they have no interest in settling.

Siding with MSFT makes life simple--otherwise, lots of complications are ahead for which he might get blamed and he does not want that. I bet even the government wants a partial victory so that life does not get too complicated (because political penalties would be paid).
Just wait and see!!!!!
We will be in for a shocker!!!
