Char, In totally virgin land you stake both mining and surface rights. In a surveyed township often all the surface rights are held by landholders, some of whom also have the mining rights. Some one would have to go to the BLM office and se what the status was on that land, vis-a vis those separate rights. You often see this where coal rights are sold to big coal and the sharecroppers own the land and have to make way for the miners(who must restore the land and file a close down pland and post a performance bond for when they finish mining). There are variations on this theme with the state and country, however Thall should be able to clarify this easily.
