Microsoft, Justice May Broach Settlement, Seattle Times Says

Redmond, Washington, Feb. 28 (Bloomberg) -- Microsoft Corp. and the U.S. Department of Justice may make overtures toward each other for negotiating a settlement of the landmark antitrust case against the No. 1 software maker during a six-week break in the trial that starts Monday, the Seattle Times reported, citing unidentified people close to the case. Microsoft executives are resolute that no settlement infringe on the company's ability to innovate, and government lawyers think they're so far ahead that they're unlikely to settle for a promise not to engage in certain practices or enter exclusionary contracts, the Times said. Still, Microsoft's stubborn streak could make any discussions awkward, particularly as the company continues to insist publicly that its case remains largely intact, the paper said.

The trial will reconvene in April when U.S. District Judge Thomas Penfield Jackson will hear rebuttal witnesses from each side, and a decision is expected between June and August. (ST 2/28 F1 www.seattletimes.com)
