[ATS: Able Telecom Holding Corp. Issues False and Misleading Statements about American Traffic Systems, Inc.]

SCOTTSDALE, Ariz., March 2 /PRNewswire/ -- James D. Tuton, President of American Traffic Systems, Inc., ("ATS") today announced that Able Telecom Holdings Corp.issued false and misleading statements in its March 2, 1998 Press Release regarding ATS.

ATS advised Able Telecom Holding Corp. ("ABTE") subsidiary, MFS Network Technologies, Inc. ("MFSNT") in a communique on Friday, February 26 of its intent to take action on Monday, March 1, 1999 if MFSNT failed to pay all past due and delinquent amounts owing.

MFSNT's referenced termination of the ATS contract was a retaliatory tactic and is baseless. ATS has never received required Notice of Default from MFSNT.

MFSNT's statement that ATS was responsible for three failed attempts to deliver the software is patently false and is actionable. The record clearly shows that MFSNT failed to deliver necessary documentation, technical specifications and stable violation images required to configure the software system. Such breaches of contract are documented in the November 6, 1998 Notice of Default as well as in subsequent formal communications with MFSNT.

On November 6, 1998, ATS provided written notice of MFSNT's numerous breaches of the contract in explicit detail. MFSNT has failed to rectify the defaults listed in such notice. In addition, ATS made eight requests for action in that correspondence in an effort to mitigate its damages while allowing MFSNT its contractual right to cure. MFSNT failed to comply and has failed to cure.

ATS previously served MFSNT on January 5, 1999 with formal notice of intent to stop work due to MFSNT's failure to pay past-due invoices.

ATS served MFSNT with formal Notice of Termination of its Agreement for the supply of Violation Processing Software for its EZPass project on March 1, 1999.

MFSNT has been advised that it has no right to use, copy, alter or otherwise manipulate any ATS Intellectual Property. ATS will file an immediate injunction to prevent the improper use of such ATS Intellectual Property by MFSNT in building its own software system.
