Because of the market forces and the impact on 3G, Qualcomm had an incentive to move the Ericy patent suit as quickly as possible.

I was actually thinking of the reverse. The longer the delay, the better it may be for QC. Why? I would assume that while all the attorneys are doing their sabre rattling, the engineers have not stopped their R&D. QC has the ability to be working on CDMA and any GSM overlay related stuff with VOD while ERICY, in theory, may be slightly handicapped by the lack of CDMA patents and experience.

The longer 3G decision is postponed, the more time QC has to work on the more favorable migration path. So aside from the fact that I hold some April calls and am wishing for a quick pop, I don't see time not being on QC's side.
