(UPDATE) Pilot Pen Sues U.S. Robotics Over 'Pilot' Brand For Handheld PCs

TRUMBULL, Conn. -(Dow Jones)- Pilot Pen Corp. filed a suit to stop
U.S. Robotics Corp. from using the word "Pilot" as the name for numerous
products, including its computerized organizers.
Pilot Pen said it charged U.S. Robotics, the nation's largest maker
of computer modems, and two of its units with "deliberate infringement"
and "dilution" of the Pilot trademarks. A spokesman said the company is
seeking unspecified damages from U.S. Robotics of "all gains and
profits" from the products.
The spokesman also said Pilot Pen, the U.S. subsidiary of Japan's
largest pen maker, is demanding that U.S. Robotics "destroy all
offending materials."
Pilot Pen said U.S. Robotics' two Personal Digital Assistants - the
Pilot 1000 and Pilot 5000 - use a stylus similar to a pen to allow the
user to input data into a hand-held tablet.
Pilot Pen said both companies' use of the Pilot name, coupled with
the similarity between the Personal Digital Assistants and the
traditional pen and paper, has caused confusion among consumers.
Pilot Pen said it has met with U.S. Robotics management but has
failed to convince the company to stop using the Pilot name.
