Man charged in finger-pointing incident

OAKLAND, Calif. (AP) -- A man accused of pointing clasped hands at another motorist and saying ''bang'' is facing a criminal charge. It turns out the other driver was a Secret Service agent.

The incident happened Monday afternoon after the two cars nearly collided in Oakland.

One of the cars was being driven by a Secret Service agent in town as part of the security detail for visiting Vice President Al Gore. The other contained passenger Terry Williams, 23, of Hayward.

After the close call, officials say, Williams leaned out of the car with his arms extended and his hands clasped as though he were holding a gun and yelled ''bang.''

The agent responded by pulling a real gun and yelling ''police.''

The car Williams was riding in then sped off, but the agent was able to stop it. Williams was arrested on a charge of making a terroristic threat. However, prosecutor Norbert Chu later changed the charge to disturbing the peace, which makes it illegal to fight or challenge someone to a fight in public.

''Gesturing like you have a gun and saying 'bang' indicates he is challenging him with a weapon. It's immediately going to provoke a retaliatory response from someone with a weapon,'' Chu said.

The prosecutor said Williams ''picked the wrong victim.''
