All- MOT's suit is not a big deal (IMHO) -

1. It's only related to V.34 (33.6k) technology - the WROST USRX will have to do if it looses is to pay a standard royalty (probably ~1% of sales). Since V.34 is an industry standard, MOT has already agree to license to anyone who wants it, including USRX. Injunctive action on X2 product (i.e., not let X2 to be sold) is unlikely since there is no irreparable harm later (i.e., you can always get money damages later).

2. The ISP will NOT be scared into NOT buying USRX products - most companies are quite willing to idemnify their customers from any potential intelletual property liability.

3. This is a clear tatic to create confusion in the market place, otherwise they would have filed this suit long ago. V.34 has been around for a long time.

4. USRX probably also has a profolio of modem patents to counter sue (I have to check), then they will just cross license each other's patents.

IMHO - practiced patent law for about 1 year+.
