Umm, did polarization become part of my argument somehow? I don't remember that part. Of course the country is polarized. So that means it has to be made illegal? All that does is stir the pot and make things worse.

I would like you to give me one instance in modern times where something you don't like (abortion, drugs, prostitution) was legalized and the whole system went to pot. It hasn't happened. Quite the reverse. Making things ILLEGAL is what has caused problems for the system (Prohibition being the most apparent, the current drug situation being another).

The Court is more exempt than other political bodies. You might wonder why...but it makes sense. Laws aren't meant to be static..they should change with the times. That is PRECISELY why the Supreme Court was devised, to interpret laws within the context of the current society. That is why the Judges have liftime seats...so that they are immune to the prejudices and politics that legislators face.
Early Israel, if you remember your Bible, was ruled by Judges because even God recognized this intangibility of static law...and the iconography that is associated with the creation of a centralized gov't. God opposed the creation of a gov't, stating that the king would enslave his own people (gee...sounds alot like our gov't and income tax). So, in a bizarre way, early Israel was far more advanced than we give them credit.
