Dan I couldn't get a borrow from Datek. I don't know the criteria Datek uses to classify a stock as "NS" or unavailable for short sales. My short position (that was covered a few weeks ago) was through Olde. Their area office had to confirm the availability of shares first before they'd execute the order, however it took a bit of prodding that was only effective based upon keeping a good cust happy.
I have noticed with a few stocks I follow that Datek's classification is dynamic, as shares of particular stocks regularly change with regards to their availability for short sales.
From my knowledge of GUMM and a statement I obtained from a reliable third party I believe that a good percentage of the float is controlled by Gunn Allen, as you have level II you should keep this in mind as you follow their activity as they're the axe.
I'm anxious to see GUMM's 10k and see how this J-V is structured
