s,

I agree that it may be relevant in the sense that you are using, but the manner in which it is being presented is a distraction to many.

I think that we should be focusing on finding out what means are available to make the slimeballs pay, both criminally and civilly. You probably won't believe this, but for several months I and others, including Riley, on the e-mail thread have been advocating a class action suit against the BOD. But, let's face it, people from all over the country, strangers really, even though they started out with a single purpose, didn't have the wherewithall to make it happen. Besides, the "evidence" was scattered and maybe wouldn't even stand up in court.

Now, with the "hard evidence" provided by tonto, and Riley, it would appear that we might have a case that a lawyer could get his/her teeth into. It had been suggested that we piggyback on Mork's suit. However, it looks like that is about to be dismissed. I don't know that I would want to align myself with Mork anyway, as I still don't know who all the "players" are in this saga.

The actions toward criminal wrongdoing, if any, should be handled by the NASD and SEC. However, there still seems to be a pretty good case under civil law, i.e., a class action suit. The players involved that we know of are people with money. Why shouldn't some of that come back to the shareholders? Now, even if we were to win a suit, I would expect that the lawyers would get most of the gravy and there would be little left for the shareholders. It would be a token and would make some of them feel better. But it might not be a token to those who have to pay. :)

That's why I would wish that we could concentrate our efforts here on perhaps organizing a plan of action. We tried this once way last spring. However, some people, on either side, couldn't resist taking pot shots and it all fell apart.

Wouldn't it be great if we all could work together and bring this to a conclusion that would give everyone some satisfaction? Of course, to do so would mean that everyone, and that means everyone, would have to put a muzzle on their ego. Oh well, probably couldn't happen. :)

Regards,

AD
