Microsoft is going to deal with the government after the rebuttal phase. In the rebuttal phase, they be talking about all the developments occuring in the industry and how Windows is always under threat.
If it gets to a ruling, MSFT will lose less than they would have to give up in a settlement IMO. However, MSFT doing well after the recess may cause some of the states to reconsider their hardline position.
