I would be very surprised to see a settlement, also:

(a) The DOJ is leery of settlements because many think they got the short end of the Win95 consent decree.
(b) You settle before the dirty laundry is revealed, not after.
(c) There is very little common ground.
(d) Both sides still think they have a good chance of winning.
(e) MSFT can drag this out for years and years before anything actually happens. The part that drains the time of their executives is mostly over.
(f) Boies is being paid $250/hour. Would you want a settlement if you were him?
