If this is not a misquote, then tokyomex is setting himself up for some difficult time in court. It's akin to someone who gets caught in speeding and loudly pronounces that "Who isn't speeding nowadays?"

There is something called prosecutorial discretion that the government has very broad discretion as to targeting a specific offender, and the fact that they lack the resources to go after all the pump-and-dumpers within th US jurisdiction is not a defense.

As for admissibility, this statement certainly is admissible in an SEC hearing. I suspect it's admissible in an actual trial under the "spontaneos or excited utterances" exceptions.
