I've been around for the entire story and it was at the very least an annoyance. The problem with filing the protest (government awards) is that it creates other problems. If you have a valid justification and you are dealing with a significant contract then protesting the sale may be the only option. I wish I had some statistics on how many of these sales are actually overturned as a result as I believe the number is extremely small. The sale could be protested for many reasons including price, performance, inability of the competitor to deliver and so on. If the contracting officer does his/her job correctly (and they usually do), all bases are covered and it is difficult to find flaws in the award. An occasional protest may not be detrimental but if the company gets to the point of filing for the sake of getting even or for to boost morale, what do you think happens on the buyers side? Bid proposals can be written in ways to benefit one supplier over another (it does happen) by writing in special performance specs/features/details which can change the outcome of an award. If you place a bug too far up the buyers tail end you only hurt your future chances. In the end IDX lost the award. If the INS buys more equipment at some point it will be interesting to see at what price the goods are awarded and who the winner will be.
