MSFT could develop a settlement strategy to include agreement to desist some of the practices that DoJ is citing. MSFT must desist anyway, so why not agree. And, technology marches on causing many of these practices to be of no benefit anyway. Why should MSFT care if the IE icon is displayed or not? With OS integration, the icon is moot.

The license agreements were never a big issue. The issue is IE, and integration in general. DOJ wants some kind of radical solution, which is why the pretrial talks broke down.

The odds are very much against a settlement, especially now since the DOJ believes the case is going well.
