You are correct. The exact words of The Settlement Class are as follows: "If you currently own or at any time since March 8, 1995 have owned any shares of the common stock of Fonar Corporation . . . or if you currently own or at any time since October 20, 1995 have owned any shares of the Class A non-voting preferred stock of Fonar Corporation
then you are a member of the class for the purposes of this settlement." So if you sold your common shares before 3/8/95, you do not participate, but if you sold after that date, you do.
