Regarding the Amendments - bkgrnd -History important to Know - 3 Categories of Law

1) Criminal Procedure
a) All of criminal procedure protections (5th and 6th amendments) Everthing except Grand jury indictment, and possibly excessive bail of 8th amendment (not matter) ARE PART OF DUE PROCESS CLAUSE
b) States are free to indict by prosecutor (not need a grand jury)
2) Civil Procedure: 7th amendment
a) Must give jury trial if more than $20.
3) Substantive Rights: only 2 need to know about
a) ONE: 1st amendment (speech, press, religion,) were incorporated into Due Process at around 1920.
b) TWO: 5th Amd, Takings clause. Encompasses right not to have property taken by state without just compensation.
