Hi WillP, If this happened in the US, no doubt some shareholders would have immediately filed a shareholder class action suite against the directors and management of Aber for breach of fiduciary responsibility with respect to providing good husbandry to the shareholders assets, holding them liable for losses of some sort. Someday Canadian shareholders will perhaps hold the officers and directors of Canadian companies more accountable. No doubt we will hear of a suite filed in some obscure county in Texas soon. regards, teevee

As a loathesome lawyer in a past incarnation, I wouldn't put any money on either Aber or WSP in the pending litigation.
If I recall correctly, that genius of stock picking, Bob Bishop, is 0 for 2 in his recent attempts to predict the outcome of litigation (that little company in Utah that was figthing Texaco or some biggie- BB actually sat in on final argument in the Utah Supreme Ct. and predicted that David would beat the Goliath- and was wrong) and the Placer Dome fight in Latin America with that well known junior that everyone remembers but I can't think of right now.
Bottom line- it could go either way, depedning of the facts, witnesses' credibility, judge(s), quality of the lawyers, etc. Don't think you can say it's going to be a slam dunk from the little anyone knows now, anyway.

Diamond willie, There is always at least one winner-the lawyers. There must be an orebody to fight over. As far as whether or not Aber or Winspear will prevail, I am sure a good lawyer (from Philidelphia or Texas perhaps) could convince a judge and jury that it is Winspear that is in default and should be penalised with appropriate damages amounting to no less than forfieture of Snap Lake.... regards, teevee |
