DEP WINS CITATION FEES FROM WASTE TIRE DISPOSAL FACILITY

PITTSBURGH (Dec. 16, 1996) – The Southwest Regional Office of the Department of Environmental Protection (DEP) recently won three summary citations totaling $3,000 plus legal costs against a Greene County waste tire disposal facility.

In August of 1994, the Department signed a Consent Order and Agreement with Rex Smith of Sycamore, after discovering that Smith and his family were collecting and disposing of waste tires on an unpermitted site in Morris Township owned by his daughter, Carmie. According to the agreement, Smith was to cease all waste tire collection, disposal and transport and begin removing tires to an appropriate facility at the rate of 1,000 per month.

Following the Consent Order and Agreement, DEP inspections found continuous violations at the site, indicating the Smiths were ignoring their commitment. False receipts and paperwork regarding the disposal of tires were found, and the tires remaining on the site were either hidden under brush or cut to alter their appearance. The Smiths also violated the Consent Order and Agreement by continuing to accept waste tires at the site.

"Tire dumps are a health and safety hazard that need to be addressed," Tony Orlando, Southwest Regional Solid Waste Manager said. "The Smiths agreed to clean up their site and their business, but instead violated the legal agreement. The department will not tolerate such action and we will continue to monitor this situation and take further action until they honor their commitment."

District Justice John C. Watson decided in DEP's favor in three summary citations against the Smiths, with fines totaling $3,000. Fines will go to the Solid Waste Abatement Fund. DEP is currently pursuing additional litigation against the Smiths in relation to the Morris Township site and the Consent Order and Agreement.

To remedy such situations, NECX is proceeding with all possible dispatch to enter into agreements with used-tire handlers, municipalities, and other entities to locate environmentally safe and approved Shreader/Recycler/Co-generation systems which will remediate this landfill congestion and general health hazard.
