For matters of enforcement, I don't believe it is going to matter whether it is public or private because in the end, if it is readable by the public, then it is public; period.
  here's the problem,
  Anyone close to the company, and I will give you a live case inpoint; 
  The public under their rights of free speech, can currently say anything they want on SI, without legal recourse because they are anonymous.
  Then, a competitor's shill can come in, slam the company and force you to defend it; 
  Then, because there are no rules for the public, but there are hosts of rules for agents of companies, etc., the agent is forced to withdraw on subjects that would expose company secrets, betray a comepetitive advantage, or endanger a contract;
  that is immediately perverted by the negative hypester, as evading issues and "proof" of all sorts of imaginary misrepresentation, when in reality, the agent has his hands tied.
  That is what has caused me to start my own website and to develop a thread for my current project, which is DCHT.
  All you need to do is go there and read the last 100 posts and you will see that the truth is not the issue; it is who can create the greater facade.
  In my opinion, these message threads are about to come under the jurisdiction of the SEC. The large brokerage firms, and the public is going to demand it, and there is little that SI can do to fight them.
  Go2Net is not going to let it continue as lawsuit losses mount, and the price of defending the anonymity of competitors shills to work unfettered continues to rise. |
