(BSNS WIRE)Polycom Withdraws Out-Of-State Challenge To VTEL Lawsuit; VTEL's Trade Secret Lawsuit Against Defendants Proceeding In Texas

Business Editors & Technology/Legal Writers

AUSTIN, Texas--(BUSINESS WIRE)--March 16, 1999--VTEL Corporation
NASDAQ:VTEL) said today that a lawsuit filed against the company by Polycom Inc. (NASDAQ:PLCM) has been dismissed by the Superior Court of California in Santa Clara County.

Polycom's lawsuit was filed in response to VTEL's $100 million lawsuit against ViaVideo Communications Inc. and Polycom. VTEL sued ViaVideo, five of its founders and Polycom in State District Court in Austin, Texas, alleging that the five individual founders, while working at VTEL, breached contracts with VTEL and violated various duties owed to VTEL.

The suit also alleges that the Defendants began work on a competing video conferencing product, using confidential, proprietary information and trade secrets of VTEL.

Polycom, which subsequently acquired ViaVideo, responded by filing suit in California, seeking to have VTEL's claims adjudicated and dismissed. Polycom's lawsuit against VTEL has now been dismissed.

VTEL's suit against Polycom and the other Defendants continues in State District Court of Travis County, Texas.
