It is a joke to assume that all contracts are followed to the letter ...every day in business verbal changes are made, approvals are done over the phone where technically a written response is required...the critical factor is WHAT WAS DONE IN THE PAST..we know that Aber "notified" WSP that it was not participating in 1998, but were they required to notify WSP in 1997 or earlier, in writing, that they were participating...or was it just assumed that they would since they participated in the drill program discussions and verbally stated they were in...it is only when there is a dispute that every runs back to the contract and scrambles to find anything "signed" to cover their position.....I am not really defending Aber because I cannot figure out what is going on, rather, I am trying to state that there is the other side of the coin here, you simply cannot assume that the WSP position is correct....I intend to call Aber today and see if I can get some idea of what they are up to on this issue..
