the project operator at a Joint Venture Management Committee meeting, Aber informed
the operator that Aber would pay its share of the budget and participate in the program,
including the bulk sampling of a diamond-bearing dyke at Snap Lake. In numerous
discussions since then, Aber has continued to inform the operator of Aber's participation
in the program."

We sure enough are reading the same thing. You will note the specific choice of language in the Aber NR.

Rather than clearly saying that;
1) Aber notified by letter of X date that Aber had elected to put up $3.8 million dollars and participate in the Program.
2) Aber did not notify Winspear of their intention to participate.

Aber have chosen to talk about something else and sue Winspear after the exploration program for what they could have had before by proper notice and sending cash. Aber has paper now, why did they have none before? What was Aber waiting for?
