Do not kid yourself, this is real litigation with firms that have records of good success. This could in time break the company. It is at least a severe distraction. The only salutary effect is that it might just get Jerry to shut up. It might also get him to accelerate his turning over more of the leadership and outside contact to those who can increase the credibility of the company. No small issue, at least in my mind, is this clown Mccoy Senior VP and Chief Counsel at AMD. It will have to be embarrassing if the other side ever asks him if he, himself, was selling all of the share that he owned during the relevant duration. As far as I can determine he did. His only justification might be that he takes it as a regular compensation and always sells. (If, in fact that is true.) If that is the case WHAT THE HELL IS HE DOING AS A PART OF HIGHEST MANAGEMENT AT AMD ? If this was not a part of a consistent pattern, then he will become a part of the opposition's case.

One hope is that this litigation may take a long time to come to fruition. One defensive move AMD might take is to declare bankruptcy as a defensive move in the future. This, obviously, will not be good for stockholders, even Jerry, though I am sure he is looking into some manner of saving things for himself.
