MSFT has a problem with the 19 states which have their own motives--lobbying from companies in their own states---you get the idea.
I think they could easily work out a deal with the DOJ itself but the states will cause the breakdown.
Microsoft is now going to give Judge Jackson the sense that they are being reasonable whereas the government (especially the states) are not. Jackson obviously wants them to settle. I would not be surprised if Jackson changes his tone when the trial resumes favoring MSFT over the DOJ in his courtroom comments. I think he will do this as his clear message to the government to reach a reasonable settlement-----and not to waste time with outrageous demands of Microsoft in any settlement. Then the courtroom theatrics will be forgotten very quickly. The 19 states will then the message!!!
Great strategy by Microsoft.
MSFT just has to ensure that Judge Jackson finds out that MSFT was being reasonable in negotiation talks. He can with just one comment make those old courtroom victories(or theatrics) seem irrelevant to the case---when it resumes.
