IBM has a lot of facilities north of New York City, doing lots of things (and presumably emitting those emissions you're worried about). East Fishkill is about 75 miles north of the city, and I believe is outside of any statistical metropolitan area. It's farm country. There's no reason to lump East Fishkill in with restrictions that might be in place in New York City or Boston.

Besides, don't underestimate IBM's ability to get through the bureaucratic maze of New York State. If they want a facility in East Fishkill, they can get the permissions to build it.
