The MM would be participating in a fraud. Besides being in direct violation of SEC rules a MM posting a bid/ask quote could face fraud charges from anyone who lost money by trading in the stock. NASD Regulation Inc. would attempt to recover trading losses incurred by the public from the MM. With all of the red flags there is no way a MM will sign off unless he is sure that he has correct information.

I don't know the specific SEC enforcement action without further research but I am sure that the MM would be shut down - at least temporarily. If I find out the what the SEC penalties are I will post that information.
