Consolidated Ecoprogress Technology president Michael Daniels faces a $235,000 suit from former director Charles Tatnall, related to a block of 250,000 shares claimed by the ousted controversial promoter. In a statement of claim filed Tuesday in the Supreme Court of British Columbia, Mr. Tatnall claims Mr. Daniels has refused to turn over the shares. The suit, filed by Vancouver lawyer Peter Norell of Grant Kovacs Norell, refers only to Ecoprogess Canada Holdings and makes no mention of Consolidated Ecoprogress, its successor. (Last May, Ecoprogress Canada changed its name to Consolidated Ecoprogress, with a consolidation of ten old shares for one new share.) The suit claims that Mr. Tatnall is and was at all "material" times the owner of 250,000 shares of Ecoprogress Canada, and a share certificate was issued in his name.
Mr. Tatnall claims he sent a letter on Dec. 21, 1998, demanding his certificate, but Mr. Daniels has either refused or neglected to deliver the shares to date. The suit claims that on Dec. 21, Ecoprogress shares were trading on the open market at $1.30 a share. (By this time, the stock was actually trading as Consolidated Ecoprogress, at $1.09.) Mr. Tatnall claims Mr. Daniels has "maliciously converted and/or wrongfully detained" the share certificate. The promoter seeks a court order for delivery of his shares, or $235,000, based on the valued of the share certificate at the time of the demand. Mr. Tatnall and associate Andrew Galloway resigned as Ecoprogress Canada directors on Dec. 17, 1997, at the request of the VSE. A week earlier, the VSE forced the pair to resign from the board of Blackrun Ventures, for unstated reasons.
