Lattimore M. Michael, CEO and Chairman says, “We believe our continuing positive results are due to our decision to reposition the Company from primarily a quick-service, double-drive-thru concept to primarily a fast-casual, single-drive-thru / dine-in concept. System-wide comparable same-store sales rose 6.0% for the year even as new concepts moved into our markets and our competitors continued deep discounting programs. This year's same-store sales increase is on top of a 7.0% increase last year. We believe this to be a favorable indicator of the positive direction of the Company's strategy and its ability to compete in a crowded marketplace.”

About Back Yard Burgers:

As of January 2, 1999, the Company's restaurant system comprised 81 units, including 33 Company-operated and 48 franchised stores compared with 77 units in the prior year, comprised of 32 Company-operated and 45 franchised stores.

Back Yard Burgers operates and franchises quick-service and fast-casual restaurants in Memphis, Little Rock, Nashville and other markets across 15 states. The restaurants specialize in charbroiled, freshly prepared, great-tasting food. As its name implies, Back Yard Burgers strives to offer the same high-quality ingredients and special care typified by outdoor grilling in the back yard. Its menu features made-to-order gourmet hamburgers and chicken sandwiches -- charbroiled over an open flame, fresh salads, chili and other special entrees as well as hand-dipped milkshakes, fresh-made lemonade and fresh-baked cobblers.

During the fourth quarter, construction was completed on a dining room addition to a Company-operated store in Memphis, Tennessee. Projects currently underway include the construction of two new Company-operated units with dine-in facilities in Desoto County, Mississippi, near Memphis; the retrofit of a double drive-thru to a single drive-thru / dine-in in Nashville, Tennessee; and the remodeling and retrofit of a second Company-operated unit in Nashville to enlarge its dining room and make it a single drive-thru operation.

Total revenues for the year ended January 2, 1999, rose 5.1% to $27,364,000 from $26,034,000 last year, resulting from an increase in same-store sales.

The Company's net income for fiscal 1998 was $1,171,000, or $.25 per diluted share, versus net income of $162,000, or $.04 per diluted share for the prior year. For the fourth quarter of 1998, net income was $430,000, or $.09 per diluted share, compared with a net loss of $261,000, or $.06 per diluted share, for the year-earlier period.
