I would think Schwab might file suit on behalf of its investors since probably some sort of contract was between schwab and the underwriter. Especially since schwab has 'promoted' the critical path stock now for free.....

Schwab would have seen revenues generated when their investors sold their shares or perhaps in the process of selling shares to the investors.

Now schwab gets nothing, but did all the work.
