How then, can MSFT provide MSN DSL Internet Access at speeds faster than what the competitors provide if they are all subject to the same specs?

Or is it that the competitors could provide the same speeds but choose not to because it is cost prohibitive? In other words, they provide a service that only utilizes say 85% of the capacity.
