The Street's sentiment regarding this trial is indifferent.

And that's what counts. Let's face it, with the trial being pushed back until at least mid May for resumption (I think this date is aggressive as Jackson's current case is running behind schedule), there is little chance of a settlement in the next few weeks.

MSFT and the Govt accomplished their goals this week when they went and stood in front of Jackson yesterday and showed how they were being well behaved boys and girls. The reality of the situation is that neither side could afford to go before Jackson yesterday and not demonstrate good faith effort towards settlement when the opposing side would.

Jackson is sick and tired of this case and he despises the potential damage to his already questioned ability that this case will ultimately cause him. This is a lose - lose case for him, and the only way out for Jackson is a SETTLEMENT. So think about it, would you want to be the one to go before him yesterday and not show settlement as your main priority? I don't think so.

But this case will not settle any time soon, and when it does, it won't be until the last moment. A settlement could very well happen in May right before the trial resumes, just not right now.

So let's get off these tiresome discussions of Settlement and get back to the fundamentals of MSFT's business and where it is headed in the foreseeable future.
