I actually enjoy the armchair lawyer game. Second guessing can be fun. I'll be the first to admit that even if we knew the issues we would not likely have sufficient expertise and analytical legal skills to recognize them, let alone apply them in the context of the law. My biggest concern is that one or both of these companies will be hurt by this mess, and I do like both companies. One thing I will say is that American law, case, statute, or otherwise is not persuasive in Canada. British, Australian, Indian, etc. are highly persuasive, particularly British. Here's to hoping it works out with a minimum of damage.

There was a large run up in volume on both these companies at about noon. Aber had a whopping amount go through just minutes ago. Does anyone know what's up?
