Ditch, sure they can short naked. That means, put up $2.00 for every share, plus the price of the share as collateral, which is the requirement for low priced securities even if you can borrow the shares and the broker still has to find the paper on the street to deliver 3 days hence.

Then, if no delivery, you know the routine, but that can only go so far under 15c.3-c Custody and control. The buy-in process starts, and you are aware that if a client makes a practice of this they are politely shown the door despite whatever protestations the broker makes.
