It matters not a whit how long you have or have not been buying this stock. What matters is whether you buy or sell *any* shares after having been given information which has not been released to the general public.

You were given this information, knowing that it had not yet been released to the public. If you bought or sold any shares subsequent to reading that report (or quite possibly to even knowing that the report was in the offing) the SEC will take a dim view of your actions.

As my Fifth Grade Teacher, Miss Pritzlaff used to say: "Zip your lip!"

And please do not try to pile hype upon hype in justifying your actions.

Voluntary disclosure: I remain long in TSIS. I am concerned only about the very risky behaviour on your part, and not upon whether the report is valid or not.
