Aber's lawyer, the scrappy Howard Shapray, further notes that Aber was concerned over Winspear's level of public disclosure during the 1998 .
Comment: I think the public disclosure issue is central to Abers suit, that being Winspear has a recorded history of not making public disclosures when material news is received.
Please see the following for substantiation:
Release of Jun 98 valuations citing 301US PER carat values based
on 200 ton bulk samples. A forced press release by Winspear after
being scrutinized by analysts after the SF Gold Show. Then the subsequent import of specialists to justify the inaccuracys of predicting grades and values on 200 ton bulk samples. However the
promotion machine was still well oiled and working.
Withholding of material news occured as well when Winspear withheld for 13 months the drill holes in Snap Lake, the premise being
experts were being called in. No problem except when a company intercepts 8.0 meters of kimberlite, I figure that is material news, maybe Abers attorney thinks so as well.

I dont think Abers attorneys will have any difficulty building the premise that Winspear withheld public information in a systematic method to achieve stock market gains, manipulation call it what you will, but Winspear will be answering some pointed questions in the days to come. Maybe the brokers as well promoting Winspear daily
on the internet.
