Being that the shares were supposed to not have been trading on 4/1, any trades will simply be reversed.
It sounds like that's what may have occurred in Jaq's account.
Courts/judges discourage litigation and the obvious remedy is nullify any trades of HARTQ on 4/1 if they were to not have traded.
The shares bought before 4/1 have value. It's just been not determined exactly what that is and can't be until all judgements are made.
As far as I know,it is not the company's responsibility or obligation to monitor trading activity of their stock. Never have I heard of that. On the contrary, I've discussed stock prices with principals and they often don't know where it closed the day before or the current price. So if they were legally obligated to monitor the activity, you would think they would know the price.
