I think the government has more of a reason to get a "good" settlement at this point. They have done better than most experts would have predicted.
Why not negotiate from a position of strength instead of risking it through a rebuttal phase. As long as the government does not want to put restrictions on product development or innovation, I could see MSFT backing down on a lot of issues. Certainly they would be giving up more than the DOJ may have even asked in the talks prior to the trial. If MSFT is asked to give up too much, I see them instead into the rebuttal phase(better prepared) to win back some negotiating points. It would make sense for the government to try and strike a deal now----I just wonder if a few states may blow it for the DOJ.
