I wouldn't think the lawsuit is a factor. As I understand it, its not for damages but for royalties on the Rio. I read somewhere that it amounted to a couple dollars per device which is already being set aside by Diamond. Certainly that amount shouldn't have a significant material affect on the company. Why do you feel that that this is the reason we haven't seen much institutional buying? I would think it has more to do with the recent weakness in the sector (PC, peripherals etc)and the fact that DIMD has disappointed the street frequently with shall we say less than stellar and erratic earnings.
IMO the institutions are waiting on the sidelines to see if the steps this company has taken to turn itself around... ie new products in high growth areas and inventory management are for real. I think if the company can produce reasonably consistent earnings this year they may pique the interest of the Wall Street. Of course a good 1Q wont hurt either.
