Remember all the stories we've heard--in my case, some from eyewitnesses--about Mikey's temper tantrums? And those really over-the-top posts by "Icabod"? Here he amusingly objects to Andy Mann's use of foul language:
25 Q. Do you recall the next -- or now at a certain point then

1 you found out that the shares that you had sent to your escrow
2 agent Creative Capital, that those shares had been somehow
3 transferred to Andy Mann?
4 A. Correct.
5 Q. How did you learn of that?
6 A. George DeMannas from Creative Capital told us when he came
7 back from Reno -- when he came back from Reno here's what he
8 said. When we found out the stock was gone and it was free
9 traded --
10 THE COURT: Now are we talking about 4 million
11 shares?
12 THE WITNESS: 4 million shares, your Honor.
13 When we found out that the stock was traded and
14 disseminated and the restriction was lifted that's when --
15 well, we confronted George and said how can that be? The
16 stock is still with you. And he said sure it's right here.
17 And that's when he called us back, and he told my father and
18 myself that I don't know what happened. It must have --
19 someone must have sent it to Andy Mann by mistake when I went
20 to Reno.

4 A. Said how can this be? I called Andy Mann frantically.

6 A. What's going on?
7 Q. Did you get ahold of Andy Mann?
8 A. Yes.
9 Q. All right. What day was it?
10 A, That's a tough one. I believe it was a Thursday.
11 Q. And where were you?
12 A. In my office.
13 Q. And did you place the call to Mr. Mann?
14 A. Yes.
15 Q. And where did you get ahold of him?
16 A. At his office.
17 Q. was anybody else present in the conversation? During the
18 conversation anybody else present to the best of your
19 knowledge?
20 A. At the beginning of the conversation, no.
21 Q, Okay.
22 A. About 5 - 6 minutes in it after some heavy talking all he
23 would do is -- I would never use profanity but he would
24 continually just use that language. And I said, asked him if
25 he never went to school.
Just amazing, isn't it, what happens whenever any of these guys goes away on a trip? How, I wonder, were those certs supposed to have been removed from Creative Capital's safe? And by whom? Mikey doesn't really seem to have been all that bothered by this: shortly thereafter Doumanis's friend John Fasano began working AZNT IR, and Mikey himself considered Creative to be his "investment bank" as late as early October, as the transcript of the hearing on the second of that month indicates. |
