I agree, no settlement for a long time. Short of an unlikely wrist-slap deal, delay is to MSFTs advantage. Anti-trust theorizes that monopolies stifle progressive change. The longer the case drags on the more change occurs, and the more unnecessary and ill-advised the DOJ's case looks. This could be important during any penalty phase.

The other factor is the state AGs. IMO, they'll never settle until they get some TV face-time to show how tough they are.

I view Jackson's encouragement of settlement talks as positive for MSFT. Just 6 months ago he severely limited MSFTs time to prepare and seemed to want to whip out a quick ruling to "fix the industry". I believe he now realizes it's very unlikely any ruling will have a positive consumer effect. His motivation then changes from pushing the law to its limits toward avoiding a ruling that might get overturned. Conservative is good for MSFT.
