The first witness was Mike Sylver, but we'll return to him later. Let's start with his father Gary. I'm sure everyone recalls that Gary lent Andy Mann 300,000 shares of AZNT stock; Titan Investments lent Mann another 180,000 shares.
Gary explains to the court that the 300,000 shares have never been returned to him. How much does he have left?
9 Q. You say you purchased 300,000 shares in 1997 for 10 $46,0007 11 A. No. This was part of -- part of the shares that I had 12 purchased. This is what I spent in 1997. 13 Q. How many shares did you have like way of purchase in 14 19977
15 A. Before I bought these? Before I -- 16 Q. How many shares do you have right now? 17 A. Right now, today? 18 Q. Yes. 19 A. I have 400 shares. 20 Q. Does that include the 300,000 shares that you've just
21 testified to? 22 A. No. 23 Q. So if you have those, you believe you have rights to 24 700,000 shares? 25 A. No, no, no, no. How do you get that?

1 THE COURT: You said 400 shares, didn't you?
2 THE WITNESS: Not -- yeah. I didn't say 400,000.
3 MR. JUDD: Oh, excuse me.
4 THE WITNESS: I said 400 shares. 5 BY MR. JUDD: 6 Q. So you believe you have rights to a total of 300,400 7 shares.
8 A. Correct.
Isn't that interesting? I'd venture, in fact, to say it's deeply interesting. According to AZNT's 1997 10KSB:
On November 10, 1998, the Company cancelled the following shares of Common issued to the Principals (and related parties) and exchanged them for preferred voting only shares:...
Gary Sylver 1,999,000
He only had 400 shares left after he made the loan to Andy?????
