Advanced Pultrusion Technologies Ltd./Power Stick Manufacturing Inc. Obtain a Preliminary Injunction for Return of its Pultrusion Machine
VANCOUVER, British Columbia, Feb. 25 /PRNewswire/ -- Further to its news release of January 16, 1997, management announces that ADVANCED PULTRUSION TECHNOLOGIES and its subsidiary company, POWER STICK MANUFACTURING, have been granted a preliminary injunction against QUADRAX CORPORATION (NASDAQ Small Cap: QDRX) in the United States District Court for the District of Rhode Island. The Preliminary Injunction allows the Company to seize its patented pultrusion machine and related equipment from Quadrax and clear the way for Power Stick to seek a permanent order and judgment on this and the seven other counts of its complaint.
The seven other counts include Patent Infringement, Violation of the Lanham Trade-Mark Act, Misappropriation of Trade Secrets, Unfair Competition, Conversion of Goods, Negligence and Prima Facie Tort. The Company is also claiming civil liability for offences, is seeking compensatory damages on six counts, exemplary damages on five counts and treble damages on the count of patent infringement.
Quadrax allegedly acquired Power Stick's patented pultrusion machine as part of an asset purchase from VEGA, USA, as announced by Quadrax on June 20, 1996. However the transaction was completely without the knowledge and consent of Power Stick. Furthermore, despite repeated requests, Quadrax failed to stop manufacturing and promoting the sale of hockey sticks manufactured on Power Stick's patented pultrusion machine.
Power Stick now intends to move its machine to an appropriate site and resume its manufacturing operation.
