This is simply false. Wash sales seem simple on the face of it but can get quite complicated.

One example where your claim is wrong. If you sell XYZ for a loss on Dec 20 and buy XYZ again on Jan 10, then the first sale is a wash sale despite holding no position across the Dec 31 date line. And the loss must be carried into the new year.
