The preferred stock was issued to holders of common in October, 1995, one share of preferred for every five common held. There will be a dividend of about 5% of the gross litigation recovery on 4 of the 5 patents at issue in the GE case. The jury verdict on the original patent, (832) which Judge Wexler overturned, was reinstated by the Appellate Court. About 5% of the litigation recovery on that patent, and that patent only, will be paid to the common shareholders. I know it sounds confusing, but those are the settlement terms of a Florida class action suit recently agreed to by Fonar.
